So they're basically saying that instead of owning IP, Patent and copyrights to Unix, they now only have a breach of contract between SCO and IBM. No wonder their stock is tanking. Lots of fun commentary about this on Slashdot at:

One has to be really grateful to Novell for purposely dropping this bombshell on SCO during their investor conference. Between this and Munich officially swapping 14,000 desktops over to Linux (despite Ballmer's visit and steep discounts,) it's proving to be a good day for OS.

SCO has just issued its own brief statement regarding Novell's
copyright claims: "SCO owns the contract rights to the UNIX
operating system. SCO has the contractual right to prevent
improper donations of UNIX code, methods or concepts into Linux
by any UNIX vendor..."
