I don't think the idea of FOSS is new - FSF was started in 1984 and it 
was started because Stallman didn't like the increasingly proprietary 
software world which threatened to take away the freedoms he had enjoyed 
earlier on. In fact, the reverse is true - creativity in copyrighted 
works of arts have been open for many years, and its "opaque creativity" 
(as Lessig terms compiled/proprietary copyrighted works of art) which is 
new.

I think the biggest problem, by far, facing the FOSS world are s/ware 
patents. Our European counterparts are doing a marvelous job in keeping 
the patents at bay but the industry pressure on pushing through the 
patents is high.
