Yes you can. You just don't ask for royalties for that particular 
patent. IBM has two initiatives in this regards, one that specifically 
excludes foss projects from the requirement of royalties for all IBM 
patents and secondly, a set of patents IBM donated which excludes any 
project from royalty (if I remember correctly from what the IBM'er was 
saying yesterday).
